Scope of effective collaboration in peruvian criminal law: a critical analysis from Casation Nº 852-2016/Puno

Abstract

This article focuses on the descriptive case study of Cassation No. 852-2016/Puno, a significant milestone in the process of effective collaboration within the framework of Peruvian criminal law. Effective collaboration has become an essential tool in the fight against organized crime and corruption, offering procedural benefits to those who provide valuable information about criminal activities. This study analyzes the criteria established by the Supreme Court in relation to the intervention of the collaborator, emphasizing that, to access the benefits of this process, the existence of direct or indirect participation in criminal acts is essential. Through documentary review and critical analysis of relevant jurisprudence, the requirements necessary for the effective implementation of effective collaboration are explored, as well as its practical implications in the justice system. Likewise, the evolution of this process in the Peruvian legal context is discussed, the challenges it faces and the opportunities it presents to improve the administration of justice in the fight against economic crimes and corruption. This article aims to contribute to the understanding of the figure of effective collaboration and its operation in the criminal field, offering a complete analysis that highlights its importance in the sustainability of a more robust and effective judicial system.
